An Indiana judge has finally rested the case: tacos and burritos are sandwiches. Judge Craig J. Bobay of Fort Wayne, Indiana, wrote in a ruling that tacos and burritos are “Mexican-style sandwiches.”
The judge made the decision in a case reviewing whether a restaurant called Famous Taco could open a new location at a Fort Wayne shopping center. The zoning policy for the property prohibits fast food restaurants, but allows exceptions for restaurants with the primary business to sell “made-to-order” or Subway-style sandwiches.
A city commission denied the request for the restaurant, but the judge ruled that Famous Taco is allowed at the shopping center because it would serve “Mexican-style sandwiches,” and the zoning policy “does not restrict potential restaurants to only American cuisine-style sandwiches.”
Other restaurants that serve made-to-order items, including “Greek gyros, Indian naan wraps or Vietnamese banh mi,” would also be allowed, the judge wrote in his decision. A spokesperson for the Allen County Superior Court said Judge Bobay does not comment on cases on his docket.

However, his ruling brought “the most food-related feedback” to the court, spokesperson John McGauley said. John added that it's the first time a ruling from the court had “shown up on Barstool Sports.”

"A Torta is a Mexican Sandwich," one person commented. "It's made with Bolillo bread. Tacos are tacos, not sandwiches."
"No it is not a sandwich," another person said. "Can maybe be closer to a wrap but still no.. It is made with one taco shell folded in half. A taco is a taco…. it's own classification in my opinion."
