Reese Witherspoon And Jim Toth’s Civil Divorce Settlement Does Not Include Child Support

On March 24, 2023, Reese Witherspoon and Jim Toth announced they were getting a divorce just five days shy of what would have been their 12th wedding anniversary. Sources close to the couple say this separation was a long time coming. They share their son, 10-year-old Tennessee, and are dedicated to co-parenting him.

Four months after the initial announcement, an amicable divorce settlement has been reached by both parties. Multiple sources are reporting it largely follows their 2011 prenuptial agreement. Reese filed for divorce citing “irreconcilable differences” on April 1, 2023, in the Circuit Court of Davidson County, Tennessee. According to TMZ, Jim and Reese signed both a marital dissolution agreement and a parenting plan on Wednesday, August 2, 2023. The documents spell out a joint custody agreement without child support. Instead the former couple will split parenting costs 50/50.

The official documents state that both parties “agree that neither party should otherwise pay monthly child support to the other parent, as the parties are sharing equal parenting time and dividing all expenses for the minor child equally.” It appears like this process was straightforward and civil. There are clauses in the agreement to make sure it stays this way.

Jim and Reese signed documents promising to “behave with each other.” This also extends to how they talk about each other when they are apart. They will not “speak badly of each other or the members of the family of the other parent.”

Jim and Reese vowed to foster “a loving, stable, consistent and nurturing relationship with the child even though they are divorced.” They will also partner with each other to make sure both parental relationships are solid. The documents include provisions to encourage Tennessee to “continue to love the other parent and be comfortable in both families.”

Beyond raising their son, Reese and Jim also had to come to an agreement on how to separate their considerable assets. According to The Blast, they stuck to their prenuptial agreement. They divided up their shared assets to the mutual satisfaction of both parties and held onto their individual ones.

When any couple breaks up, it is natural to speculate on the reasons behind it. A source close to the couple told Page Six there was no big dramatic story here. “There’s no big scandal or drama, just two people who essentially became coparents and don’t really have any romantic feelings for each other anymore,” they told the outlet.

Jim and Reese have been mostly silent on the reasons behind their divorce. There has been speculation that Jim was going through a bit of a midlife crisis, especially since leaving his agent job at CAA and heading up the failed streamer Quibi. The couple has not confirmed this.

Reese did open up to Harper’s Bazaar about wanting to control the narrative about her divorce this time around. She felt the media took that away from her in her first divorce from actor Ryan Phillippe.

“When I was divorced before, the tabloid media got to tell people how I was feeling or how I was processing, and it felt very out of control,” she explained. “To be able to talk to people directly about what’s going on in my life … it feels much more authentic to be able to say things in my own voice and not let somebody else control what’s happening.”

According to People, Jim was recently spotted on vacation in Costa Rica with a possible new love interest. "Jim was staying with a new girlfriend at the Sendero Nosara in Costa Rica,” a source told the outlet. "They seemed to be staying in a suite, and they looked really happy, just chilling and soaking up that pura vida vibe. It was definitely romantic."
